In Geogria Uncontest Divorce Is Much Less Traumatic Than A Protracted Court Battle

By Martha Butler

Social and religious experts agree that healthy families remain the most important component of healthy societies. Sadly, more and more marriages fall apart and during the past few decades the number of single parent families have rocketed. Ending an intimate relationship is never easy, especially if there are children involved. There are always a lot of emotions involved and in many cases the final separation is acrimonious. With a Geogria uncontest divorce couples can at least separate in a civilized manner.

Divorcing couples must think twice before they opt for a contested separation. There are many drawbacks. Each partner will have to hire a separate lawyer and this will be extremely expensive, especially if the matter proceed to court. They must also consider the fact that a contested divorce case is heard in open court and that the parties involved cannot insist on privacy. Every detail is part of the public domain and may be published.

Before a marriage can be dissolved many decisions have to be made and both partners have to agree to those decisions. In uncontested cases the couple can list all the decisions that must be made and discuss them one by one. A lawyer can help such couples to understand their legal rights and obligations. In this way agreement can be reached without having to fight matters out in open court.

Even if a marriage is dissolved in the most amicably way possible, it is still important to obtain professional assistance. The laws governing marriage unions and the dissolving of such unions are complex because the rights of all the parties have to be protected. It is therefore best to hire the services of an objective lawyer or counsellor to facilitate the negotiation process. A facilitator can make sure that the agreements reached are fair.

Unfortunately, an amicable dissolving of a marriage is not always possible. In instances where the separation is caused by physical, emotional and sexual abuse, or where one partner simply refuses to cooperate there may be no other option other than to sue for a contested divorce in open court. In some cases a couple simply cannot agree on an important issues such as custody matters or the division of assets.

Even an uncontested separation can become expensive. Lawyers charge by the hour and their rates are not cheap. If both parties are reasonable, they will try their best to come to some form of agreement on most of the issues facing them before involving a lawyer. The lawyer will simply have to check the legality of the decisions made and to draw up a final overall agreement.

Uncontested separations offer many advantages when compared to contested separations. It is private because the agreement reached by the couple is presented to a judge in his chambers and the made an order of the court. The partners involved do not even have to appear in court. It is also much cheaper, with only one lawyer involved.

Relationship experts argue that it is always worth it to try and salvage broken relationships, especially long standing ones. This is unfortunately not always possible and thousand of people still go their separate ways every month. At least uncontested cases protect everyone concerned from public scrutiny.
